[vserver] vserver and lxc on same kernel

Is the vserver patch expected to interfere with lxc? From my
understanding I would expect to be able to run both on the same kernel,
but with 3.10.40-vs2.3.6.8
lxc container wont start:
# lxc-start -n webv1 -d
lxc-start: command get_state failed to receive response
on 3.10.40, same .config but without vserver patch this works fine.

# grep VSERVER /boot/config-3.10.40-vs2.3.6.8
