perhaps i was not clear sorry, i have in my vserver 2 mounted drive a
/var and a /tmp so the empty vserver looks like this

/vservers/vserver01
/vservers/vserver01/tmp
/vservers/vserver01/var

tmp and var are also mounted like /vservers/vserver01

i was pretty sure that without force it just told me the file existed
