this is the same error that apeared in xfs acl section, one workaround was
to substitute IS_IMMUTABLE with IS_IMMUTABLE_FILE, but that was with
really old kernel, look for newer ext3 acl..

sure, why not. At least when you use ol, well-tested filesystems.
